By booking the class, participant accepts and agrees to the Release and Wavier below.

豁免书和免除协议

1. 作为参与上述活动（以下简称为“活动”）的对价，本人特此同意并承认，本人完全知晓参与该活动可能引发风险，本人愿意承担所有活动风险，即使这些风险是由豁免方（定义见下文）或其他任何人疏忽大意、过失或重大过失而引发。

2. “权利主张”包括但不限于因参与该活动引起损失、个人伤亡所致的任何或全部责任、索赔、要求、法律行动或权利主张。豁免方指露露乐蒙贸易（上海）有限公司以及其全部关联方、特许经销商以及前述公司或机构的代表人、董事、管理人员、代理人、雇员和志愿者。

3. 本人同意并承认：(a) 本人的身体条件适于参加该活动并且本人知晓参加该活动在某些情形下可能导致身体伤害、严重的身体伤害或死亡；(b) 本人了解自己的身体状况，有在生病或受伤之前及时停止活动的充分自觉； (c) 本人知晓如果该活动发生在户外，则活动期间该活动所在区域附近街道将会有正常车辆交通，本人会遵守所有的交通法律法规。

4. 在可适用的法律所允许的最大限度内，本人特此为本人及继承人、近亲属、执行人、管理人和受让人，完全免除、放弃并永远放弃任何或全部本人现在或将来的针对任何豁免方的权利或主张，即使该主张是基于任一豁免方或任何其他人的疏忽大意、过失或重大过失。不限于以上规定，本人进一步放弃任何本人现在或以后可能获得的由任何被豁免方的决定引起的追索权。

5. 本人同意不因任何权利主张起诉任何豁免方，即使该主张是由任何豁免方或任何其他人的疏忽大意、过失或重大过失所引起。本人同意补偿（归还任何损失）并且使每一位豁免方免于因应诉由本人或其他人以本人名义提起的诉讼而造成的任何损失或责任（包括任何合理支出的律师费），即使该权利主张被认为或确实由任何豁免方或任何其他人的疏忽大意或过失所引起。

6. 本人知晓，参与该活动之前咨询医生较为明智。如本人确实咨询过医生，则本人已采纳医生的建议。

7. 本人知晓，活动期间没有人有义务向本人提供医疗服务。本人了解并承认： (a) 该活动可能不提供任何救助站点；并且(b) 如有任何为本人提供的医疗服务，并且提供服务当时本人无法表示同意，应视为本人已经同意。

8. 本人允许每一位豁免方及其任何受让人或许可使用人以任何目的使用可能描绘、记录或提及本人的该活动的照片、电影、录像、录音或其他该活动的记录（统称为“影像”），包括允许豁免方及其赞助商和许可使用人因商业用途而使用。上述使用许可不受任何时间限制，可以在全世界范围内及网络上使用。本人了解并同意，本人不会因同意影像使用而获得任何补偿，本人亦不会有机会收取、检查或者批准可能使用影像的推广营销材料、信息或内容。本人特此使任一豁免方，包括但不限于所有使用或制作、记录或修改影像的人免于受到任何各类的主张、起诉、损失、利益、成本、支出或赔偿，无论它们是否是已知的或未知的，是否为本人现在所知或以后可以享有，是否与创造、使用或处理影像有关或者以何种方式有关。

9. 本人承认并同意，任一豁免方应当在全世界范围内拥有关于该影像和任何包含全部或部分影像的任何材料的所有权利和权益，并且任一豁免方有权不受限制地使用、许可、出售、转让或以其他方式处分其部分或全部上述权利以及在本豁免书和免除协议享有的权利，以任何方式且无需向本人负责或说明。本人特此向每一位豁免方转让本人在全世界范围内享有的针对影像及任何包含全部或部分影像的任何资料的所有权利与权益，包括附属其上的知识产权。本人特此不可撤回地放弃任何任何或全部本人的道德权利以及任何其他本人在全世界范围内享有的针对影像及任何包含全部或部分影像的任何资料的权利。

10. 本人进一步承认并同意，本协议应当受中华人民共和国法律管辖并按照中华人民共和国法律解释，不包括其冲突法规则。

11. 如果本协议任何条款违法、无效或不因任何原因可执行，该条款应视为与本协议分离，不影响本协议任何其他条款的效力和执行。

12. 如果活动参加者小于18周岁或具有不完全民事行为能力，其父母或监护人同意以下陈述：作为参加者的父母或监护人，本人同意该参加者参加活动。本人同意，如果参加者或任何人以其名义提起任何权利主张，本人将按照第5条提供补偿并且使豁免方免于损失，且本人同意本豁免书和免除协议的条款。在参加者需要医疗紧急情况救助的情况下，如果豁免方不能联系到本人，本人同意并授予许可，允许任何豁免方向参加者提供医疗服务。

13. 本人已全部阅读并同意本协议。本人知晓，签署本协议将放弃本人或本人的继承人、近亲属、执行人、管理人和受让人可能享有的针对豁免方的某些法律权利。

RELEASE AND WAIVER

1. In consideration of joining in the above-described event (the “Activity”), I agree and acknowledge that I am fully aware that participation in the Activity may involve risks and I accept all the risks of participating, even if the risks are created by the carelessness, negligence or gross negligence of a Released Party (as defined below) or anyone else.

2. “Claims” includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, personal injury or death in connection with participation in the Activity. “Released Party” means lululemon athletica Trading (Shanghai) Co. Ltd. and all of their affiliates, franchisees and their respective representatives, directors, officers, agents, employees and volunteer staff.

I agree and acknowledge that: (a) I am in proper physical condition to participate in the Activity, and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death; (b) I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured; and (c) I am aware that if the Activity occurs outdoors, the streets adjourning the area of the Activity are open to regular vehicular traffic during the Activity and I will obey all traffic laws and regulations.

4. To the fullest extent permitted by applicable law, I hereby, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any and all rights or Claims I may have, now or in the future, against any Released Party, even if the Claims are based on the carelessness, negligence or gross negligence of a Released Party or anyone else. Without limiting the foregoing, I further release any recourses which I may now or hereafter have resulting from any decision of any Released Party.

5. I agree not to sue any Released Party for Claims, even if the Claims arise from the carelessness, negligence or gross negligence of any Released Party or anyone else. I agree to indemnify (reimburse for any loss) and hold harmless each Released Party from any loss or liability (including any reasonable legal fees they may incur) defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the carelessness or negligence of any Released Party or anyone else.

6. I am aware that it is advisable to consult a physician prior to participating in the Activity. If I have consulted a physician, I have taken the physician’s advice.

7. I am aware that there is no obligation for any person to provide me with medical care during the Activity. I understand and acknowledge that: (a) there may be no aid stations available for the Activity; and (b) If medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.

8. I grant my permission to each Released Party and any transferee or licensee or any of them, to utilize any photographs, motion pictures, videotapes, recordings and other references or records of the Activity which may depict, record or refer to me for any purpose (“Images”), including commercial use by the released parties, their sponsors and their licensees. This permission is for use anywhere in the world and on the Internet and for an unlimited period of time. I understand and agree that I will not be compensated or receive additional consideration for consenting to the use of the Images and that I will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that may use the Images. I hereby release each Released Party including, without limitation, all persons who took or otherwise created, recorded or modified the Images, from any and all claims, actions, damages, interest, costs, expense and compensation of whatsoever kind and howsoever arising, whether known or unknown, and which I now have or at any time hereafter can, shall or may have in connection with, or in any way resulting or arising from, the Images and the creation, use or disposition of them.

9. I acknowledge and agree that each Released Party shall own all right, title and interest, throughout the world, in and to the Images and any materials compromising all or any part of the Images, and that each Released Party has the unrestricted right to use, license, sell, transfer or otherwise dispose of any or all of them, as well as each Released Party’s rights under this Release and Waiver, in any manner whatsoever and without any accountability to me. I hereby assign to each Released Party all right, title and interest, throughout the world, I may have in and to the Images and any materials comprising all or any part of the Images, including all intellectual property rights thereto. I hereby irrevocably waive any and all of my moral rights and any other irrevocable rights I may have, throughout the world, in or to the Images and any materials comprising all or part of the Images.

10. I further acknowledge and agree that this agreement shall be governed by and construed in accordance with the law of the People’s Republic of China, without regard to its conflict of laws rules.

11. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

12. If the participant is less than 18 years of age or has limited civil capacity, the parent or guardian agrees to the following statements: As a parent or guardian of the participant, I authorize the participant to participate. I agree that in the event the participant, or anyone acting on his or her behalf, makes any claim, I will provide the indemnity and hold harmless described in paragraph 5 and I agree to the terms of this Release and Waiver. In the event of a medical emergency involving the participant and any Released Party is unable to contact me, I agree and grant my permission that any Released Party may provide medical care to the participant.

13. I have fully read and understand this agreement. I am aware that by signing this agreement, I am waiving certain legal rights I or my heirs, next of kin, executors, administrators and assigns may have against the Released Party.
